Gjyqtari vler\u00ebsoi konstatimin paraprak t\u00eb nj\u00eb shkeljeje thelb\u00ebsore t\u00eb dispozitave t\u00eb procedur\u00ebs penale sipas nenit 415, paragrafi 1, pika 11 e KPP-s\u00eb, por nuk e pranoi at\u00eb si t\u00eb bazuar, duke pasur parasysh se vendimi i arsyetuar nuk p\u00ebrmban mang\u00ebsi t\u00eb tilla q\u00eb nuk mund t\u00eb shqyrtohen n\u00eb aspektin e korrekt\u00ebsis\u00eb dhe ligjshm\u00ebris\u00eb s\u00eb tij, vendimi \u00ebsht\u00eb i qart\u00eb dhe i kuptuesh\u00ebm, dhe arsyetimi p\u00ebrmban arsye t\u00eb mjaftueshme p\u00ebr faktet vendimtare dhe q\u00ebndrimet ligjore t\u00eb mbajtura nga gjykata&#8221;, thuhet n\u00eb vendimin e Gjykat\u00ebs s\u00eb Apelit.<\/p>\n<p>Vendimi \u00ebsht\u00eb nj\u00eb konfirmim i vendimit t\u00eb Gjykat\u00ebs Penale t\u00eb dhjetorit, i cili gjithashtu thot\u00eb se nuk ka hap\u00ebsir\u00eb ligjore p\u00ebr p\u00ebrs\u00ebritjen e procedur\u00ebs.<\/p>\n<p>T\u00eb akuzuarit kan\u00eb njoftuar n\u00eb disa raste se q\u00ebllimi i tyre \u00ebsht\u00eb p\u00ebrs\u00ebritja e gjykimit dhe se nuk k\u00ebrkojn\u00eb amnisti.<\/p>\n<p>K\u00ebta njer\u00ebz nuk po k\u00ebrkojn\u00eb amnisti, ata po k\u00ebrkojn\u00eb drejt\u00ebsi.
